The new “ambush election” rule is the latest in an ongoing effort by the Obama administration to use NLRB rulings to provide unions with tools giving them an upper hand over employers when targeting employees for union organizing.
These rules will cut the time between unions filing representation election petitions and elections from 42 to 21 days or less, and require employers to file legal statements of position within 7 days of a hearing notice. Matters not raised in the legal statement of position will be forever waived.
